check this out,
I bought a polaris rzr from a guy in utah,
he bought it from a dealer in florida.
in nevada if you purchase from a private party
you don't have to reg. or pay sales tax.
I was the third owner.
I sold it to a guy in havasu, he took it to get it reg.
and AZ dmv said he had to pay sales tax?????
I also bought two new honda dirt bikes, and
two new 450 honda quads,
the dealer in vegas, ride now, gave me the
mso's.
does this mean if you buy from anywheres else
in the united states you don't have to pay tax
except from nev.????
if I wanted to sell one of my dirt bikes I would have
to sell it for 9% cheeper, just to be equal???
I told the guy that I would refund his money and
un wind the deal,
I don't know what to do at this point, I want to be fair
but AZ dmv is mak'n up the rules a s they go!!!
anyone had a simular experience????
-
by the way, if the guy that bought it from me
lived in nev, there would be no tax due,
if I would have kept it, I would not owe tax,
if some one from cal bought it, tax would be due
I feel that the guy that bought it from me
did so think'n there was no tax due,
I feel responsible in a way,
what do you think

The guy in AZ needs to prove that along the line someone paid sales tax. A copy of the original selling invoice should do if it shows the VIN. AZ MVD is creepy on this, NOT even an MSO will work, they want the copy of registration or orogonal bill of sale. Fins out the selling dealer and get a copy showing tax was paid.

IMO, you are not responsible for sales tax laws in yours or any other State. No need for you to refund or unwind anything due to sales tax.

I would still give his dough back,
what I found out was the guy in utah bought 10 rzrs from a
florida dealer, he took delivery in utah and said he would
be titling them there to avoid sells tax, he never went and registered
them so he thinks he don't have to pay the tax.
I think that when the state of utah gets wind of this, his as$
is liable, and he'll have to pay the tax. I also told the guy in utah
that he needs to make this right, he said something like piss up a rope

Someone has to pay tax UNLESS you have a title in his name and he signs that title for sale and gives it to you. The title must be in his personal name and the sale will be considered private and no tax will have to be paid.
However, doesn't sound like the guy has a title with his personal name on it.

Call AZ Dept of Revenue (The Tax police), ask them who's responsible for sales tax. If no sales tax is due then get a signed tax exemption from them and see what AZ DMV has to say.
-
also, when I first bought it, I called nev. dmv to see if I had to bring it in for a vin inspection, so I could get it titled. they said they don't have anything to do with quads and dirt bikes unless they will be driv'n on the street

Nv. just changed the law around April that private party sells would not have to pay sales tax. prior to that you would have had to pay sales tax if titling and registering for use on the road. I got nailed a couple times on vehicles with this.
was there ever a title? maybe he could get a "bill of sale" from someone in Az. isn't it if you buy it and register it in Az. you don't pay sales tax? don't know if it would work but maybe worth a try. i've done this for a couple friends in Utah.

I just bought 2 honda dirt bikes, 2 450 honda quads
a450 kawi and a polaris ranger, all of which I paid
nv. sales tax. all i got for owner ship is the mso's
I bought 2 joyner comando's and a 800 joyner sandrail
and paid nev. sales tax but got az titles.
I gave him a bill of sell on the RZR but they still want him to pay tax
