StealthMarine needs a new name....

I am sure all of you are going to love this one.
After going round and round for months now our lawyers have told us that we need to cease and decist in the use of the word "Stealth" in the name of our business or the name of our boat.
Seems the word "Stealth" is trademarked for all business uses by a guy who makes his living in attempting to license it any and all who want it. The lawyers think we could win after a long and protracted legal battle, the end result of which would be that we would have spent ten's of thousand's of dollars and end up right where we are today.
So, rather than waste a ton of cash on being totally non-productive and just lining our lawyers pockets we have decided to change the name of the business.
And this is where it gets fun.
I am looking for suggestions for a new name???????????
So long as it is NOT Trademarked, Copyrighted or Obscene, I am open to all suggestions.
Give it your best shot and lets see what all the ***boaters come up with.

I would LOVE to.
Buy after looking into this guy long and hard it is very clear he makes his living litigating. Our lawyers warned us that this guy would not be above using every dirty trick in the book to win the trial. And as such our legal costs would be HUGE if we decided to pursue. Several other companies ARE fighting him, but they have much larger resources that we do.

Honestly, you guys are a small shop and I can't see how it would be worth this guy's efforts to pursue this. If you cave he gets nothing, if you don't how does he really profit? I understand all about the cost of "playing the game" with the lawyers so I don't need a lecture there, Just trying to figure out his motivation. Without knowing what exactly you've been served with, it's hard to say, but honestly it sounds like you'd be fine. Besides, the guy ain't very smart because it would have been much more apealing to go after Ultra (I think their annual production is just slightly more than yours ;) ) for their use of his term in their product line.

The guy that is doing this has been making his living at this for many years.
There is an entire online forum dedicated to the people he has attacked and VAST are the numbers of businesses in the USA he has come after. He is a lawyer that registeres "trademarks" on anything and everything he can get his hold on and then sells a license to use them. He made us an offer that was so over the top as to be rediculous. But he does hold the trademark on the word "Stealth" and very agressively goes after any and all that will not bow down to him.
If he looses a battle, he looses only his personal time, if he wins, he gets a settlement and royalties for years to come. His upside is MUCH better than our upside.

I strongly suspect he ONLY goes after those who are not going to be able to mount a serious battle against him.
His goal is to collect royalties.
in our case he was out there in never never land with what he asked for.
If he had wanted a couple hundred bucks for each boat, I would have probably just swallowed the cost of it and moved on with business.
But he wanted more than we make in Net Profit on each boat.
The guy has no sence of reality.

I think "Virage" is a good example of that. is there anything local for inspiration i.e. Copper Canyon Marine, Sandbar Marine ?, if I were a Boat Builder where I lived, I could name the Boat "El Toro" Marine after the prominent Hill overlooking the Town.

Stealth Marine, sorry to hear some J@ck@ss wants to rule the world . The same thing happened to my cousin with his surf products name "NEWBLEND". The guy wound up paying nathan 5 or 10k as nathan had inserted the word NEW in front of BLEND. but still the same basis as you problem . This industry is highly fragmented and would not see common interest in something like that unless it directly involved each and every player.

But, much to my surprise the powers that be changed their minds and settled in on the winner instead. I sent the name off to the attorney to have a trademark and copyright check done. As yet I have not heard back from him.

Its just a desire to stay as far away from Lawyers and Courts as I can.
The guy has a Trademark on the word "Stealth" and if we continue to use it we will end up a in a suit. Whether or not we will is beside the point, We would have to litigate it and that would be a waste of time and money.

We are going through the trademark registration process.

Weds the lawyer sent me a note letting me know we have run into the first problem with the new name.

This whole process of renaming the company is ponderously SLOW.
Found out yesterday that the trademark office will NOT allow a trademark on the word "Marine" as it is part of the common domain. You would think that the word "Stealth" would be the same, but its not.

Such a pain in the butt to have to deal with people like this....
Now we have to come up with the new logos and graphics.
Then change the www site and start the process of changing all the legal stuff.
Will be working on this for the rest of the year.
