Wrong, I know of 2 people who were taken in for less then a .08. Both were released, one was charged and was thrown out do to not being over the limit (.04) and passing all the field tests. Oh, yeah it was at Havasu right when AZ changed over to the lower legal limit. The LE didn't have a clue if anyone else one the boat had been drinking or if there was anyone capable of driving the boat.

Yeah they can take you on anything if one ability is impared. Hence the "feild tests". I am sure in many cases a dui does not even relate to drinking. Could be anything that impares ones driving ability.
