A guy in our group got stopped on his quad coming back from the Desert Bar last Saturday on the dirt road about a mile in from the road (95). They stopped two guys and let one go. The guy they kept got the complete field sobriety test and then agreed to do the breathalyzer. His BAC came up as .042, so the sheriff wrote him up for reckless driving. The sheriff told him that someone had called on the radio reporting two guys on quads who were going too fast on the dirt road.
Question: Does he have any chance of fighting this? I can give you the sheriff's name if you'd like.
