TMZ.com has learned the reason Paris Hilton stayed at home while the lawyers and judge sat in court is because the Sheriff's Department refused to pick her up.
Law enforcement sources tell TMZ the Sheriff's position is that the judge does not have the power to order her to court. The Sheriffs believe they have sole jurisdiction to monitor and control Hilton while she is under house arrest.
The Sheriff's Department says they are the only ones authorized to take her anywhere. Thus, the standoff in court.
The issue may have been resolved, but that is why the hearing was delayed this morning.
The judge the DA are fighting with the sheriff....the judge is theatening the entire sheriffs department with contempt of court. I wonder how you can arrest the entire sheriff's department.....
The judge it pissed! He specifically wrote on his order "no home release or electronic monitoring".....

Here's what's going down in court right now. Judge Michael Sauer said, before Paris was released, he was contacted by theSheriff and told they would file a motion to place Paris under house arrest. The judge said the motion was never filed, and added, "There's no way I would have approved it even if I got the motion."
The prosecutor, Dan Jeffries, who is also pissed at the Sheriff, accused the Sheriff of "assuming all three roles of the criminal justice system," claiming "Sheriff Lee Baca is interpreting the law all by himself."

Exactly. I don't get the uproar. She did more time than ANYONE I know that has gotten pulled over for the exact same infraction.
I have personally driven (in my younger, stupider years) with a suspended license, from a really similar incident as well. I don't think any jail time was justified... most don't do any.
I don't understand the hatred for her in this situation. We aren't talking about driving around with a heroin needle hanging out of her arm and a head full of whip-it's... we are talking about "reckless driving" and "driving with a suspended license".
So you all hate the rich party girl... great... we get it. I don't.
It is a small act to look at someone who has something you don't, or is getting away with something you aren't and blow the whistle on them. I personally try to figure out a way to get some for me too... but not by bringing their good deal down.
I think she got the opposite of preferential treatment. I think she got the book thrown at her because of perceived entitlement.
What would have been hilarious would have been her getting driven to the court in a white 1990 Ford Bronco... I have been cracking up all morning thinking about that one! :D

Topless is right. Very few people ever do time for driving on a suspended license. County jail is much too crowded. Over 95% of inmates are in for felonies, many awaiting prelim or trial.
The LASD, (and many neighboring counties) is under Federal court order to keep inmate population to a certain number...so they started the ankle bracelet house arrest monitoring system. Many people are released early into this program to serve the remainder of their time at home EVERY DAY.
Paris got caught up in a debate among judges, prosecutors, and the sheriff (who is mandated to run the jail). This political debate has been going on for decades and just now most tards are starting to get clued in.
If Paris was poor, she never would have been sentenced to jail in the first place, just made to do community service hours.

Paris Hilton was just ordered back to jail in Lynwood to serve out the remainder of her sentence! She'll get credit for 5 days already served.
Hilton left the courtoom in tears, screaming, "Mom, Mom, Mom."
One witness described the scene as: Paris was "physically escorted" out of the courtroom by a female deputy.
Hilton's mother was later seen pacing the hallways, telling reporters, "I'm paralyzed right now." Rick is still in the courtroom.

TMZ was all the talk in open court today.
Judge Sauer said, "I heard Harvey Levin on radio on 710 this morning," discussing that Paris would testify by phone. The judge said he had been unaware that this plan was brewing. Paris' lawyer, Richard Hutton, also said he heard the news from TMZ.
The judge then said he saw the story on TMZ with the headline, "Get Your Ass To Court."
The judge said no one had agreed to telephone testimony. For the record, the court spokesperson told TMZ the testimony would be given by phone.
The judge, whom TMZ has trashed for handing down a 45-day sentence, said, "That tells you about the reputation of some news agencies. Not FOX news, but TMZ."
The judge then said, "Enough of Harvey Levin for the day."

She deserves jail time and to do the full term. She's not being punished for the original offense - for which she got no jail time; she's being punished for disregarding the conditions of her probation. Throw the book at her. She already got off with the sentence being reduced to 23 days.

If she played it off like it was a joke and had a sense of humor about this whole thing, the public would have received it in an entirely different light. It might have even helped her "rich brat" PR. But it's quite obvious that she has never had to rough it, and she is probably crying more about the fact that they didn't let her put on her make up before they took her to court more than any other reason. Maybe she is upset they don't serve sushi made to order for the solitary confinement prisoners. I was kind of hoping she would get sent into population. I remember watching her being interviewed at a party once and she said "I love it here, only beautiful people are allowed." I wonder what she would have to say if she was in population and became the whole prison's carpet cleaner.

From what I heard, the original charge was reckless driving, 70 in a 35 zone. That led to a suspended license, which led to her arrest after getting pulled over again.

I don't think you should go to jail for lots of things though.
Agreed. Prison should be for violent crimes. Murder, arson, rape. I have a liberal opinion on drugs: legalize them all. Don't punish a person for taking a drug simply because it wasn't manufactured from Pfizer, punish them for crimes they commit. You wanna sit at home and smoke dope and do lines all night long, fine. But if you do that and then hit your wife, then you should go to jail. I guess I am trying to say that a person should not sit in jail just for lifestyle choices.
Oh and any person convicted of a sex related crime towards a minor should be executed.
Now here is another thing to think about. When you commit a crime, you are punished. We punish people by fines, labor and imprisonment. Personally, I would rather sit in jail than have to pay an enormous fine because I am just a worker Bee. With Paris, money means nothing to her. You can't hurt her with any kind of fine. The only way to actually punish her, is to imprison her. I think that is what the judge was thinking.
Yeah, BS traffic violations are very petty, but that's the law and she could have avoided the whole thing by being smart, which she was not.
Like the saying goes: It's too bad stupidity is not painful.

Example of what? Corruption in the legal system? Biased sentencing? Total disregard for logic?
I don't think it should be up to the judge to decide what type of sentence will hurt her the most. He should make rulings with an unbiased view of the sentence, and above all else practice consistency.
What a terrible message to be sending the world.
If she was on her third offense for the same type of deal, and the traditional sentencing didn't do the job because it didn't effect her, then start to get creative with taking away things personally important. The judge assumes that a fine, court appearances and negative publicity wouldn't have worked. Judges shouldn't assume anything.

So far, I haven't heard one factual bit of news on this case. The major agencies are all disagreeing.
The orginal charge was DUI. Her license was suspended (like everyones is in California) and she was put on probation. Then she got caught twice driving on a suspended license, once for speeding and once for reckless driving. She also did not go to court ordered alcohol classes (like everyone else has to do with a DUI).
That's three violations of her probation.
Then she shows up late for her court hearing. She obviously has a problem with authority and following the law. She could probably use a 24 day reality check....might do her good, might save her life.

Honestly, I didn't know the original violation was DUI. Additionally, I didn't know she was caught twice driving with a suspended license.
That is pretty careless. She has options, and chose not to take them. Third infraction for the same thing... probably should spend a couple of nights in jail.
I still don't get the hatred. Or the concern for that matter. I am far more interested in everyone getting riled up about it than the case itself. I find it unnerving that there was five helicopters over her house this morning, with a fleet of news vans. I am more upset that I know that... but it appears unavoidable...
