Not if that ship was "Restricted In It's Ability To Manuver" (RAM) or not if the ship "Not Under Command" (NUC) and most definatly not if that ship was operating in a channel.
But yes sailboats usually have the right of way.
Still a shitty day for the sailboat people!!!

Boatcop had some good observations and facts on this deal in the original thread that I linked a few posts back. ;)
I use that video in my Boating Safety Course. It's probably about 20 years old by now.
It was an Insurance job, by the way. The sailboat owner couldn't keep up the payments and picked a pretty bad method to pay the thing off.
Unfortunately, (for him) the accident investigation picked up on the scheme, and the carrier refused payment and filed fraud charges.
