Absolutely...
I figured as much. It is just weird that some employees were paid their full severance and others got taxes witheld.
Could not find a specific link to any laws concerning this issue.

Usually depends on how the word the benefit package.
i.e. If the package says 1 week for every year worked, then it's earned income and should be taxed, If worded as a gift then they can tax it or not.

Severance pay, just like vacation pay or regular pay, is compensation and is taxed.
However, all the stuff you steal from your office on the last day is exempt. :D :D
