Ok i bid and won an auction on a salvage car i wanted to rebuild. I contacted the seller to arrange pickup and payment and he informed me the car was worth more than i won the auction for and he refused to sell it to me at that price. It was a reserve auction and i not only met the reserve but surpassed it. How do i deal with this a-hole. I am in NY and he is in pa. What if any recourse do i have to get my car.

all you can do is complain to e-bay and leave negative feed back so others won't have to deal with him. but I don't think you can force him to sell you the car.
He will be liable for the fees to e-bay but they are nominal.
Sorry for your bad luck, I have always been lucky when I purchase from e-bay. but I always check their feedback first and if they have anything negative that hasn't been resolved I stay clear of them no matter how good the deal is.

I think the legally binding contract dealio goes both ways, just like if you won the auction but deadbeated out and didnt pay. Contact e-bay and present your story and let them hammer it out.

It is a contract so you could probably sue the guy to perform on the deal. But Hammer's way is probably cheaper and much more effective :)

It is a legally binding contract. You can go to court and make him sell it.
Problem is that you have to enforce it (not the Hammer way either, although hammer has a good idea!)

I do believe that any and all transactions (Buying and Selling) on e-bay are legal binding contracts.
I know each tim eI bid there is a reminder that My bid is a legal and binding contract. I would assume that it would go both ways.. :D

They are legal and binding contracts. Like any legal issue though you have to spend money and effort to sue and enforce. Probably not worth it. What kind of feedback did this dude have? I won't even bid on things that don't have some + feedback history. Too easy to get screwed with non-delivery or something.

Jurisdiction can also be a problem…is it where the seller resides, or where the buyer resides? Both could be argued, but ultimately you would have to sue in the sellers state to enforce anything.
Here in Cali, you can’t sue somebody in Cali small claims if they reside out of state (except for very specific real property issues). Big problem when dealing with ebay contracts gone south.
Nailing his feedback is about all you have.

$2,162.00 is a screaming deal for thatcar. How much did he expect to get out of it.

Makes me want a volvo. The interior of that car looks brand spankin new still. Did a hell of a job withstanding a roll over thats for sure.

I also won this one and the day before it ends the guy adds to the description that he wont take less than $3K, but it was a no reserve auction, my bid limit was $2,200. nobody else thought it was worth that I guess. I'm not going to bother with the legal part, he's new at it, your guy had never sold anything, I don't buy from first timers,

Newbies sellers/buyers are usually where most problems start. Guys like your dealing with are bad news. I'd send Hammer to "splain it to em"

Only thing I would watch for if the guy is forced to sell you the car...is that he tears the car up to make is worth even less...
you know like take a hammer to it or some shit..

Man ya gotta check the feedback before bidding, this guy is a total cockbag! Sorry to hear a fellow board member got hosed but at least it didn't cost you anything.
Did anybody email the seller? I was thinking about it.:mad:
