SAN ANTONIO, Texas - Texas has begun sending undercover agents into bars to arrest drinkers for being drunk, a spokeswoman for the Texas Alcoholic Beverage Commission said on Wednesday.
The first sting operation was conducted recently in a Dallas suburb where agents infiltrated 36 bars and arrested 30 people for public intoxication, said the commissionÂ’s Carolyn Beck.
Being in a bar does not exempt one from the state laws against public drunkenness, Beck said.
The goal, she said, was to detain drunks before they leave a bar and go do something dangerous like drive a car.
“We feel that the only way we’re going to get at the drunk driving problem and the problem of people hurting each other while drunk is by crackdowns like this,” she said.
“There are a lot of dangerous and stupid things people do when they’re intoxicated, other than get behind the wheel of a car,” Beck said. “People walk out into traffic and get run over, people jump off of balconies trying to reach a swimming pool and miss.”
She said the sting operations would continue throughout the state.

So what are the standards for "drunk in public"??? Same as DUI???

It was on the news this morning....they showed the police arresting some drunk lady, in the hotel bar.......her point was she was NOT going to hurt anyone, just go up to her room and sleep. She wasn't drunk in public, she was drunk in a bar........and they arrested the bartender.......

You can be falling down drunk or staggering on your Own Property ...if YOU CAN BE SEEN by any PUBLIC or venture onto Public property they can arrest you !
I live on 20 acres with a Hwy passing 200yards from my house at leastor farther...I had put new tires on my 4x4 truck and after a very rainy weekend was out in the field cutting up ,seeing how high mud would fly , trying to get stuck ,etc... :crossx:
I have a very good friend who is a Constable that happened to drive by and warned me that if a DPS drove by they would probably take me in for at least public intoxication..it might not have stuck but why take a chance ??? I asked him how in the heck can I be arrested on my own land ???
He answered if the Public can see you they can arrest you...fer instance...
OK.... you own your own house , Climb up on the roof naked with your significant other ,nude and have Sex :p The odds are your going to jail..same idea behind this drinkin' law....

You never win.Go to bar or anywhere for that matter get drunk.Decide to be good and not drive.Ride a bike,skaeteboard,horse,ec still can get a dui.
Walking home can get you a drunk in public.But i think the latter will be an atttitude test with the officer.

Heard a interview the other day from one of the undercover, they are looking for the drunk person over board and which bar keeps serving them :rolleyes:

A bar is a public place. You can be arrested in California for Public Intoxication in a bar - if (in the officer's opinion) you cannot care for your safety, or the safety of others. Been that way for awhile. It's just making news in Texas.
